This End User Licence Agreement (“Agreement”) is a binding agreement between you (“End-User” or “you”) and FozDigital LTD (“Licensor,” “we,” “us,” or “our”). This Agreement governs your use of the PerkLedger Browser Extension (the “Software”). The Software is licensed, not sold, to you.
By adding, installing, or using the Software, you (a) acknowledge that you have read and understand this Agreement; (b) represent that you are of legal age to enter into a binding agreement; and (c) accept this Agreement and agree that you are legally bound by its terms.
1. SCOPE OF LICENCE
You are granted a non-transferable, non-exclusive, revocable licence to install and use the Software on compatible web browsers (e.g., Chrome, Edge, Firefox, Safari) on devices owned or controlled by you.
You may not:
- Modify, translate, adapt, or otherwise create derivative works or improvements of the Software.
- Reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive or gain access to the source code of the Software.
- Remove, delete, alter, or obscure any trademarks or copyright notices from the Software.
- Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available the Software to any third party.
- Use the Software for any purpose that is illegal or prohibited by this Agreement.
- Engage in “cookie stuffing,” forced clicks, or the overwriting of other affiliate marketing cookies without the user’s explicit action. The Software is designed to activate affiliate tracking only when you actively engage with a “Claim Reward” or “Activate Perk” button.
2. DATA AND PRIVACY
The Software may collect and process information about your usage, including visited URLs (strictly for finding relevant perks), clicked affiliate links, and technical device data. This collection is essential for the functionality of our Discovery Rewards programme.
All data collection and processing are governed by our Privacy Policy. By using the Software, you consent to such processing.
3. INTELLECTUAL PROPERTY
You acknowledge that the Software is provided under licence, and not sold to you. You do not acquire any ownership interest in the Software under this Agreement. FozDigital LTD retains all right, title, and interest in and to the Software, including all copyrights, trademarks, and other intellectual property rights.
4. UPDATES
We may from time to time provide enhancements or improvements to the features/functionality of the Software, which may include patches, bug fixes, updates, upgrades, and other modifications (“Updates”). Updates may modify or delete certain features and functionality. You agree that we have no obligation to (i) provide any Updates, or (ii) continue to provide or enable any particular features or functionality.
5. TERMINATION
The term of Agreement commences when you install the Software and will continue in effect until terminated by you or us. You may terminate this Agreement by deleting the Software and all copies thereof from your devices.
We may terminate this Agreement at any time without notice if it ceases to support the Software, which we may do in our sole discretion. In addition, this Agreement will terminate immediately and automatically without any notice if you violate any of the terms and conditions of this Agreement.
6. DISCLAIMER OF WARRANTIES
THE SOFTWARE IS PROVIDED TO YOU “AS IS” AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
7. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FOZDIGITAL LTD BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES.
8. GOVERNING LAW
This Agreement is governed by and construed in accordance with the laws of England and Wales.
